Dianké.ai operates an AI-powered receptionist platform for restaurants, salons, and small businesses. This Privacy Policy explains how we collect, use, and protect information when customers interact with our platform on behalf of our business clients.
By using Dianké.ai powered services, you agree to the collection and use of information as described in this policy.
2. Information We Collect
When you place an order or interact with a Dianké.ai-powered business, we may collect:
- Your name (as provided during ordering)
- Phone number (optional, used for order notifications)
- Email address (optional, used for order confirmations and reviews)
- Order details including items, total, and order type
- Payment preference (cash, card, Cash App, Venmo, or Zelle)
- Language preference
- Conversation content with our AI assistant
- Timestamp and which business location you ordered from
3. How We Use Your Information
- Process and fulfill your order
- Send order confirmation and status updates via WhatsApp or SMS
- Notify you when your order is ready for pickup
- Send a review request after your order is completed
- Help the business owner manage their operations
- Improve our AI assistant's performance
4. Who Can See Your Data
- Dianké.ai — for operational and support purposes
- The restaurant or business you ordered from — limited to their own customers' orders only
- Twilio — our messaging provider, who processes phone numbers to deliver WhatsApp and SMS notifications
- Anthropic — our AI provider, who processes conversation content to generate responses
- Stripe — our payment processor, who handles card payment data independently
We do not sell your personal information to third parties or use it for advertising purposes.
5. Data Retention
Order data is retained for up to 12 months, after which it may be deleted or anonymized. You may request deletion of your data at any time by contacting us at hello@dianke.ai.

7. Canadian Users (PIPEDA)

8. New York Users (SHIELD Act)
We implement reasonable security measures to protect your personal information in compliance with the New York SHIELD Act, including encryption of data in transit and access controls on our database.

All data is stored in Supabase, a SOC 2 compliant database provider. Communications are encrypted using industry-standard TLS encryption.
10. Children's Privacy
Our platform is not directed at children under the age of 13. We do not knowingly collect personal information from children under 13.

Terms of Service
1. Agreement to Terms
These Terms govern your use of the Dianké.ai platform, including all AI receptionist services, ordering systems, and dashboards. By accessing or using our platform, you agree to be bound by these Terms.
2. Description of Service
Dianké.ai provides an AI-powered receptionist platform enabling businesses to:
- Accept customer orders via a mobile-friendly web interface
- Manage orders through an owner dashboard
- Send automated WhatsApp and SMS notifications to customers
- Accept payments through third-party payment processors
- Communicate in English, French, and Wolof
3. Restaurant Client Responsibilities
- Provide accurate menu information, pricing, and business details
- Fulfill all orders placed through the platform in a timely manner
- Maintain accurate payment account information
- Not use the platform for any unlawful purpose
- Keep dashboard login credentials confidential
- Comply with all applicable laws regarding food service and customer data
4. Subscription and Payment
Subscription fees are due monthly at the beginning of each billing period. We reserve the right to suspend access if payment is not received within 7 days of the due date. Fees are non-refundable except at our sole discretion. Pricing changes require 30 days written notice.
5. Free Trial
We may offer a free trial period to new clients. At the end of the trial, a paid subscription is required to continue using the platform.
6. Customer Orders
Dianké.ai acts as a technology intermediary between customers and businesses. We are not responsible for the quality, preparation, or delivery of food or services. All disputes regarding orders should be directed to the restaurant directly.
7. Payment Processing
Payments via Stripe are subject to Stripe's Terms of Service. Dianké.ai does not store credit card information and is not responsible for payment disputes between customers and payment providers.
8. AI-Generated Content
Our platform uses AI powered by Anthropic's Claude. While we strive for accuracy, AI responses may occasionally contain errors. Restaurant Clients are responsible for ensuring their menu information is accurate.
9. Limitation of Liability
Dianké.ai shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid by the relevant party in the three months preceding the claim.
10. Termination
Either party may terminate with 30 days written notice. We reserve the right to terminate immediately for violation of these Terms. Client data will be retained for 90 days after termination before deletion.
11. Governing Law
These Terms are governed by the laws of the State of New York. Disputes shall be resolved in the courts of New York County.
